Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all contracts between Sync Motion GmbH, Niedergams 39, 8524 Deutschlandsberg, Austria (hereinafter "Provider") and the customer for the use of the email validation service "Alpinemail" (hereinafter "Service").
Deviating terms and conditions of the customer are not recognized unless the Provider expressly agrees to their validity in writing.
2. Subject of the Contract
The Provider provides the customer with an API-based service for validating email addresses. The service includes:
- MX record check
- SMTP verification
- Detection of disposable email addresses
- AI-based fraud detection
3. Contract Conclusion and Registration
The contract is concluded by the customer's registration and confirmation by the Provider. By registering, the customer accepts these GTC.
The customer is obliged to provide truthful information during registration and to update this information immediately in case of changes.
4. Services and Availability
The Provider strives for an availability of the service of 99.5% on an annual average. Excluded from this are times when the server is not accessible due to technical or other problems that are outside the Provider's control.
The Provider reserves the right to further develop and adapt the service. Significant changes will be communicated to the customer in a timely manner.
5. Prices and Payment
The current prices are available on the Provider's website. The following applies:
- Free: 100 API requests per month
- Pay-as-you-go: €0.01 per request from the 101st request
- On-Premise: Individual pricing on request
All prices are exclusive of statutory VAT. Billing is monthly. Invoices are payable within 14 days of the invoice date.
6. Usage Rights and Restrictions
The Provider grants the customer a non-exclusive, non-transferable right to use the service.
The customer is prohibited from:
- Using the service for illegal purposes, especially for sending spam
- Sharing API access credentials with third parties
- Overloading or disrupting the service
- Circumventing or manipulating security measures
- Reselling the service without prior consent
7. Data Protection
The Provider processes personal data in accordance with the General Data Protection Regulation (GDPR). Details on data processing can be found in the Privacy Policy.
Email addresses validated via the API are not permanently stored and are used exclusively for validation purposes.
8. Liability
The Provider is liable without limitation for intent and gross negligence. In case of slight negligence, the Provider is only liable for breach of essential contractual obligations and limited to the foreseeable damage typical for the contract.
The Provider does not guarantee the accuracy of validation results. The results serve as a recommendation and do not replace the customer's own verification.
9. Contract Duration and Termination
The contract is concluded for an indefinite period. Both parties can terminate the contract at any time with 30 days' notice to the end of the month.
The right to extraordinary termination for good cause remains unaffected. Good cause exists in particular if the customer violates essential provisions of these GTC.
10. Amendments to the GTC
The Provider reserves the right to amend these GTC. Amendments will be communicated to the customer at least 30 days before they take effect by email. If the customer does not object within 30 days of receipt of the amendment notification, the amended GTC are deemed accepted.
11. Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Graz, Austria, if the customer is a merchant.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
